Rights, obligations and liability limits when using our boat rental platform.
These terms apply to the rental of motorboats, sailboats and water sports equipment via the website cairnsboatrental.com. Rental is exclusively for leisure and recreational purposes. Commercial use or subletting is not permitted.
A binding rental agreement is concluded upon booking confirmation. Cancellations are possible free of charge up to 48 hours before the rental period begins. For later cancellations, we reserve the right to charge a cancellation fee of 50% of the rental price. The exact cancellation deadlines are transparently displayed before the booking is completed.
The renter undertakes to take over the boat in a seaworthy condition and to comply with all applicable navigation rules during the rental period. Only persons with a valid pleasure craft license (or equivalent license) are permitted to operate the boat. Alcohol and drug consumption while driving is strictly prohibited.
The lessor is liable for damages resulting from gross negligence or intent. The lessor assumes no liability for damages caused by improper operation, violation of traffic regulations or force majeure. The renter is liable for all damages to the boat and accessories incurred during the rental period up to the amount of the agreed deductible.
We collect and process personal data (name, address, license data, payment information) exclusively for contract processing and in accordance with our privacy policy. Disclosure to third parties only occurs insofar as it is necessary for the processing of the rental agreement (e.g., insurance, port authorities).
We reserve the right to change these terms of use with a notice period of 14 days. Changes will be communicated by email. If the user does not object within 14 days, the new terms are deemed accepted. In the event of serious violations of the terms, access to the platform may be blocked immediately.
